MANILA, Philippines — It will be “no work, no pay” for daily wage earners on Friday, declared a special non-working holiday by President Rodrigo Duterte for the opening ceremony of the 30th Association of Southeast Asian Nations leader’s summit, which the country is hosting.
“If the employee did not work, the ‘no work, no pay’ principle shall apply unless there is favorable company policy, practice or collective bargaining agreement granting payment on a special day,” Labor Undersecretary Claro Arellano said at a press conference.
But workers obliged to report to work on Friday will be getting an additional 30 percent on top of their daily wage for the first eight hours of work, he added.
The other pay rules included in Labor Advisory No. 4, series of 2017, or the Payment of Wages for the Special Non-Working Day on April 28, 2017, are as follows:
- For work done in excess of eight hours (overtime work), he/she shall be paid an additional 30 percent of his/her hourly rate on said day (Hourly rate of the basic daily wage x 130 percent x number of hours worked);
- For work done during a special day that also falls on his/her rest day, he/she shall be paid an additional 50 percent of his/her daily rate on the first eight hours of work [(Daily rate x 150 percent) + COLA];
- For work done in excess of eight hours (overtime work) during a special day that also falls on his/her rest day, he/she shall be paid an additional 30 percent of his/her hourly rate on said day (Hourly rate of the basic daily wage x 150 percent x 130 percent x number of hours worked).
